Acknowledgment. By using our site, you are agreeing to comply with the terms of use set forth in this document. Please review the terms carefully. If you do not agree to, or are unable to, comply with the terms set forth, you should not use www.goestateplans.com (the “Site”). The term “GoEstatePlans,” Waller & Co,” “us,” “we,” “our,” or “the Firm” refers to Harvey Jack Waller & Associates d/b/a Waller & Co. I.  The term “you,” “reader,” or “viewer” refers to the user of this Site. The term “Services” refers to all services provided by us.

BY USING GOESTATEPLANS OR ACCESSING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE AND AGREE TO BE BOUND BY THEM.

Ownership. This Site is owned and operated by GoEstatePlans. All right, title and interest in and to the materials provided on this Site, including but not limited to information, documents, logos, graphics, sounds and images (the “Materials”) are owned either by the Firm or by our respective third party authors, developers or vendors (“Third Party Providers”). Except as otherwise expressly provided by the Firm, none of the Materials may be copied, reproduced, republished, downloaded, uploaded, posted, displayed, transmitted or distributed in any way and nothing on this Site shall be construed to confer any license under any of GoEstatePlans intellectual property rights, whether by estoppel, implication or otherwise. The Firm does not sell, license, lease or otherwise provide any of the Materials other than those specifically identified as being provided by the Firm. Any rights not expressly granted herein are reserved by the Firm.

License to Use. GoEstatePlans grants you a limited, personal, non-exclusive, non-transferable license to use our Estate Plan forms (the “Forms”) for your own personal use, or if you are an attorney or professional, for your client. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Forms in any manner, except for modifications in filling out the Forms for your authorized use. You shall not remove any copyright notice from any Form.

Resale of Forms Prohibited. By purchasing our Estate Plan, you agree that the Forms you purchase may only be used by you for your personal use or used by you in connection with your client and may not be sold or redistributed without the express written consent of GoEstatePlans.

Privacy Policy. Our Privacy Policy as detailed on the Site is made a part of these Terms & Conditions and incorporated as though fully set forth herein.

Compliance with Intellectual Property Laws. When accessing www.goestateplans.com or using the Firm’s legal document preparation Service, you agree to obey the law and you agree to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright, trademark and other intellectual property ownership. You agree not to upload, download, display, perform, transmit or otherwise distribute any information or content in violation of any third party’s copyrights, trademarks or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third party rights caused by any content you provide or transmit or that is provided or transmitted using your user account.

GoEstatePlans has adopted a policy that provides for the immediate removal of any content, article or materials that have infringed on the rights of the Firm or of a third party or that violate intellectual property rights generally. The Firm’s policy is to remove such infringing content or materials and investigate such allegations immediately.

Question and Answer Session. The website or Question and Answer Session does not provide legal advice. It is designed to collect relevant information and data to assist in the preparation of a legal document on your behalf.

The responses you provide in the Question and Answer Session will dictate the content of the document produced.

When using the Question and Answer Session you will be asked a series of questions; the answers you give will dictate the content of your final Estate Plan (referred to hereafter as “Estate Plan” or “Documents”). You alone are responsible for ensuring the answers or any information that you give is correct (this includes information in relation to the identity of any parties or signatories, their age or capacity). GoEstatePlans relies on you providing the correct information.

You must carefully check that your responses to the Question and Answer Session and Estate Plan received produced fully reflects your wishes. If it does not, you should not execute your Estate Plan add is your responsibility to ensure that any document is properly executed in accordance with the instructions that are provided to you.

Documents are prepared in accordance with Illinois law. You should not use them in any jurisdiction outside the State of Illinois or if any person who is to sign it, or the property the Document deals with, is outside of Illinois.

All Documents should be used in conjunction with proper advice from GoEstatePlans as to their application and adaptation to your particular circumstances.

Documents  and Question and Answer Sessions completed will be stored by our firm for a period of time.

Inappropriate Content. When accessing the Site or using GoEstatePlans you agree not to upload, download, display, perform, transmit or otherwise distribute any content that: (i) is libelous, defamatory, obscene, pornographic, abusive or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or foreign law or regulation; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. GoEstatePlans reserves the right to terminate or delete such material from its servers. The Firm will cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms and Conditions or of any applicable laws.

Governing Law.  By using this Site, you expressly agree that your rights and obligations shall be governed by and interpreted in accordance with the laws of the State of Illinois.
